Icon About This Course

Blockchain continues to drive technological innovation while posing novel regulatory and compliance challenges. This course examines why effective, jurisdiction-wide regulation is essential for fostering legitimate growth and deterring abuse, and surveys current approaches in the United States, Switzerland, China, Russia, and the European Union. Building on a comparative law lens, the course identifies cross-border themes, highlights areas for reform, and equips practitioners to spot risks, advise clients, and engage with evolving policy debates, including considerations in illicit finance enforcement.

The course is designed for attorneys and legal professionals advising on fintech, compliance, corporate, securities, or cross-border matters. No technical background required. Familiarity with basic blockchain concepts is helpful but not required, as the core elements of blockchain technology will be discussed.

Participants will leave with a clear comparative map of leading regulatory approaches in other countries, including a deeper understanding of recent litigation, legislation, and regulatory developments in the United States, issue-spotting frameworks to advise clients operating across multiple sectors, and an understanding of why cohesive, globally minded regulation is central to unlocking blockchain’s benefits while mitigating substantial illicit-use risks. The course also highlights pragmatic areas for reform that practitioners can monitor and incorporate into strategic counseling.

Learning Objectives:

  1. Review the policy rationale for comprehensive blockchain regulation to promote beneficial uses while constraining illicit activity.
  2. Examine recent litigation, legislation, and regulatory developments in the United States, including a high-level comparison of regulatory approaches across Switzerland, China, Russia, and the European Union.
  3. Identify common regulatory gaps and reform priorities that global jurisdictions should consider.
  4. Recognize how blockchain can facilitate significant illicit activity and why coordinated responses matter.
  5. Develop issue-spotting frameworks for client counseling, compliance design, and risk assessment.
  6. Evaluate cross-border implications for transactions, operations, and governance in a multi-jurisdictional environment.
