Immigration Law: Common Pathways and Visa Types

About This Course
This course provides valuable insights into the common pathways utilized by foreign nationals to enter the United States, based on market observations rather than solely relying on USCIS statistics.
Attendees can expect a comprehensive overview of frequently inquired visa types, along with a novel strategy for transitioning from an E2 visa to a green card. Additionally, participants will gain knowledge about additional professional resources accessible to immigration counsel, aiding them in effectively representing their clients.
This introductory/intermediate-level program is designed to benefit immigration attorneys seeking a broad understanding of the current immigration market demand and professional resources to enhance their practice.
Learning Objectives:
- Develop an “immigration plan” and an “immigration financial plan” for clients to emigrate to the United States
- Investigate the most common methods foreign nationals are emigrating to the United States, marketplace, and United States Citizenship and Immigration Services (USCIS) statistics
- Explore the EB5–Visa (employment-based fifth preference category or EB-5 Immigrant Investor Visa Program), and how it provides a method for eligible immigrant investors to become lawful permanent residents—informally known as "green card" holders—by investing substantial capital to finance a business in the United States that will employ at least 10 American workers
- Discover the E2–Investor Visa, which allows an individual to enter and work in the United States based on an investment in a United States business and the new EB–2 “Plus” strategy fast tracking the E2 to “green card” status
- Explain how the EB2–National Interest Waiver (NIW) Visa allows for a national interest waiver of the standard labor certification process; special considerations for Brazilian and other Latin American emigrants
- Discern the differences between the L1 and EB1C Visas
